Notice and Disclaimer Regarding SERI’s Liability Concerning the Use of the R2 Standard, R2 Documents, and Other Content on This Website

The R2 Standard, Guidance Document, Implementation Guide, and any other R2 document or web-based statement disseminated by SERI that describes, recommends, or requires any process or practice (“R2 Documents”) are developed through a consensus standards development process. This process brings together volunteers representing varied viewpoints and interests to achieve consensus on environmental, health, safety, and data security matters relating to the electronics recycling and refurbishing industry. While SERI administers the process and establishes rules to promote fairness in the development of consensus, SERI does not independently test, evaluate, or verify the accuracy of any information or the soundness of any judgements contained in R2 Documents.

SERI disclaims liability for any personal injury, loss of business, or any other damages of any nature whatsoever, whether special, indirect, consequential, or compensatory, directly or indirectly resulting from the use of, or reliance on any R2 Document. SERI also makes no guaranty or warranty as to the accuracy or completeness of any information set forth in any R2 Document.

Anyone using an R2 Document should rely on his or her own independent judgement or, as appropriate, seek the advice of a competent professional in order to exercise reasonable care and business judgement in any given circumstance.

SERI does not conduct the audits upon which the decisions to certify a company are based, nor does it make the decisions about whether a company is qualified to be certified to the R2 Standard. SERI does not issue the R2 certifications nor is it in any way responsible for assuring that R2 certified companies conform to the requirements of the R2 Standard. Any certification or other statement of conformance with the requirements of the R2 Standard or any other R2 Document are solely the responsibility of the independent certifying body issuing the certificate or the person or entity that made the statement.

SERI has registered certification marks for the R2:2013 and R2v3 Standards (collectively, the “R2 Certification Marks”) and issues licenses for the use and display of the R2 Certification Mark(s) by organizations certified through a process provided in the R2 Code of Practices. SERI also owns a trademark registration for the well-known R2 trademark for its provision of best practices standards with respect to recycling. While SERI is vigilant in the prevention of public confusion and other infringement of its R2 related intellectual property, SERI does not claim sole rights to use of the term “R2” outside of the certification services and other services for which SERI’s trademarks and certifications marks are registered.

By its issuance or non-issuance of a license for the use of the R2 Certification Marks, and/or by SERI’s clarifying statements as to which facilities or organizations are so licensed, SERI intends to make no other statements, and expresses no opinions, whether express or implied, regarding the performance, capabilities, or any other characteristics of certified or uncertified facilities or organizations, and hereby disclaims any such statements.

SERI and all SERI Programs do not discriminate on the basis of race, color, religion, sex, age, or disability.
